REQUEST FOR PROPOSALS: TRACING SERVICES FOR EXPRESS CREDIT LTD
Overview
Express Credit Ltd (hereinafter referred to as “the Company”) is a public company registered in terms of the Companies Act, 2011 licensed by the Central Bank of Lesotho to operate as a Credit-Only Tier II Microfinance Institution, with its principal offices at Shop No. 4 LNDC Centre, Kingsway, Maseru 100.
Express Credit is undertaking a single-step open Request for Proposal for delivery of non-committal and non-exclusive nation-wide tracing of its debtors for recovery and debt collection purposes.
The tender invites experienced, qualified, duly registered and compliant Tracing Firms to submit a proposal covering both non-price and price components, to be exclusively submitted in electronic format.
The services are provided exclusively to support and improve the Company’s debt recovery and collection processes by independently tracing and locating delinquent debtors, on an as and when required basis in various districts across Lesotho.
The proposal shall include a detailed operational plan, which demonstrates an understanding of, and capability to assume responsibility for tracing clients and debtors whose whereabouts are unknown to the Company and its internal Debt Collection team.

Scope of Services
- Investigate and trace for and on behalf of the Company, the whereabouts, location and up to date addresses of such debtors/clients as the Company shall from time to time instruct;
- Investigate and trace for and on behalf of the Company the existence, location and whereabouts of any immovable property of value belonging to and to which any of the Company’s debtors hold rights and interests, which may be executed for purposes of enforcement of judgment debts, as shall be instructed from time to time;
- Compile and provide a comprehensive report of each case that they are instructed to provide tracing and investigative services to;
- Advise the Company of any relevant information that may be helpful to the Company, provided that such advice shall not be binding to the Company and that the Company shall retain the autonomy to make its own decisions
Terms of Reference (ToRs)
Consequence of Submission of Proposal
- The Company shall not be obligated to respond to any proposal submitted nor be legally bound in any manner by the submission of a proposal;
- Acceptance by the Company of a proposal obligates the Firm to enter into an agreement with the Company;
- The agreement shall not be binding or valid against the Company unless and until it is fully executed by both the Company and the Firm;
- The Company reserves the right to amend the project scope, any information contained in this RFP is for informational purposes only.
- Only proposals that are compliant and meet the criteria for the RFP shall be considered. Firms are requested and expected to be fully compliant with all governing legislation of the Kingdom of Lesotho to qualify for consideration under this RFP.
Acceptance or Rejection of Proposal
- The Company reserves the right to select the successful proposal and negotiate an agreement as to the scope of services, the schedule of performance and the duration of the services with Firm(s) whose proposal(s) is/are most responsive to the needs of the Company. Further, the Company reserves the right to reject any and all proposals or alternate proposals or waive any informality or irregularity in the proposal as is in the Company’s interest.
- The Company reserves the right to reject any and all proposals or portions thereof, received in response to the RFP or to negotiate separately with any source whatsoever, in any manner necessary, to serve the Company’s best interests. Additionally, the Company may, for any reason and without being obligated to disclose such reason, decide not to award an agreement(s) as a result of this RFP.
- Non-acceptance of any proposal shall not imply that the proposal was deficient. Rather, non-acceptance of any proposal shall mean that another proposal was more advantageous to the Company or that, in the event that the Company decides not to award an agreement pursuant to this RFP, it was more advantageous for the Company to so decide.
Right to Change or Amend Request
The Company reserves the right to change the Terms of Reference of this Request. The Company will notify potential Firms(s) of any material changes through official communication channels that shall be solely determined by the Company. No one is authorized to amend any of the Request requirements in any respect by an oral or written statement or to make any representation or interpretation in conflict with its provisions. Failure by any Firm to not have received and/or been aware of such information and/or clarifications/answers shall not relieve such Firm from any obligatory requirement under its proposal as submitted.
ANY EXCEPTIONS TO THIS RFP SHALL BE CLEARLY STATED IN WRITING AND SHALL BE COMMUNICATED THROUGH OFFICIAL CHANNELS ONLY.
Disqualification
Any of the following may be considered cause to disqualify a Firm without further consideration:
- Evidence of collusion among Firms submitting proposals under this RFP;
- Any attempt to improperly influence any member of the evaluation panel;
- Suspicion of fraud, collusion to commit fraud, terrorist financcing, money laundering and/or any other financial crime under the Money Laundering and Proceeds of Crime Act, 2008 (as amended);
- Non-compliance with the laws of the Kingdom of Lesotho governing the Firm’s operations and regulations;
- A Firm’s default in any operation of a professional services agreement which resulted in the termination of that agreement;
- Existence of any lawsuit, unresolved contractual claim, or dispute between the Firm and the City.
Submission Requirements
The Firms are required to follow the RFP information provided in submission of their proposals. Proposals shall meet the following minimum requirements:
- Detailed operational plan which demonstrates understanding of and capability to assume responsibility for tracing the Company’s delinquent debtors and clients;
- Demonstrate competence of the firm, including but not limited to, showing background, experience, and key management/tracing team members, including their qualifications and experience;
- List of any disciplinary or investigative action, including audits, in the past five (5) years conducted by any professional body or regulatory authority against the firm, if any, including the outcome thereof;
- List any and all litigation, pending or final, to which you are a party that is related or similar to the services being solicited in the past five (5) years;
- Financial proposal: manner of billing and tarriffs and/or scope that shall be used for such billing, including a detailed basic fee structure and breakdown of any other charges related to the proposal.
References
Provide a listing of five (5) Financial Institutions, body corporate and/or government clients, to whom your firm or agency has provided collections/tracing services over the last five (5) years.
Indicate each organization’s name, address, reference contact person and title, telephone number, and e-mail address. Additionally, describe the nature of services provided, the engagement’s initial date, and the contract’s expiration date.
Proposal Guidelines, Content and Format
Express Credit uses a qualifications-based selection criteria to obtain these services. In order for the Company to properly evaluate the Firms’ qualifications to perform this work, the proposals shall include, as a minimum, the following information:
- Evidence of the Firm’s ability to be responsive to this project in regards to timeliness and expertise, including the availability of staff proposed to be assigned.
- A cover letter on the Firm’s letterhead addressing the proposal and format, duly signed by an officer of the firm with authority to bind the firm to all terms provided in the proposal, and shall include the name, address, phone number and e-mail address of the authorised contact person representing the firm.
- Certificate of Incorporation, Trading License and Tax Clearance attached as annexes
