Project Background
The Lesotho Highlands Water Project (LHWP) is a multidisciplinary, multistage, binational project undertaken by the Governments of the Kingdom of Lesotho and the Republic of South Africa in accordance with a Treaty signed in 1986.
The Lesotho Highlands Development Authority (LHDA) has been appointed as the custodian responsible for the delivery of this project.
To proactively manage disputes during construction, Dispute Boards (DBs) have been established for construction contracts in accordance with the 2010 FIDIC Conditions of Contract for Construction (Multilateral Development Bank Harmonised Edition – “Pink Book”). This principle also applies to contracts administered under the Joint Building Contracts Committee (JBCC) Principal Building Agreement, May 2018 Edition 6.2.
Anticipated Contracts Requiring Dispute Boards
A: Feeder Roads & Bridges
- 95 km of rural roads
- 4 pedestrian bridges (250 m to 700 m in length)
- 6 vehicle bridges (72 m to 420 m in length)
- Anticipated number of contracts: 8
- Construction commencement: Q1 – Q3 2027
B: Oxbow Hydropower Project (3-member DB)
- 100 m high RCC dam
- 85 m high intake tower
- 6.6 km headrace tunnel (3.6 m diameter)
- 4.2 km transfer tunnel (to ‘Muela reservoir)
- 80.3 MW powerhouse (Pelton turbines)
- Approximately 20 km access roads
- 2 × 132 kV transmission lines (approx. 10 km)

C: Social Development
- Roads and infrastructure
- Resettlement Relocation Contract

Background to the EOI
LHDA established a shortlist of potential Dispute Board members in 2017. This list will no longer be used once a new shortlist is established following this Expression of Interest.
Eligible individuals are invited to express their interest in providing these services. LHDA intends to limit nominations to a shortlist of Dispute Board members, adjudicators, and mediators based on submissions received.
Eligibility Criteria
Applicants must be fluent in English and meet the following requirements:
- At least twenty (20) years of relevant professional experience
- Professional registration in civil engineering, construction management, other built environment disciplines, or relevant qualifications in construction law
- Previous experience as:
- An adjudicator
- A member of a Dispute Board
- A Dispute Review Expert
on projects with a construction value of at least USD 25 million (regional and local experience is an advantage)
- Membership in a recognised association of adjudicators or arbitrators
- No conflict of interest
- Eligibility to participate in and be awarded LHDA contracts
Accreditation by FIDIC (or a FIDIC Member Association) as a FIDIC Adjudicator is a significant advantage.
