The National Home Builders Registration Council (NHBRC) is a statutory body, established in 1998, in terms of the Housing Consumers Protection Measures Act, 1998 (Act No. 95 of 1998). It is mandated to protect the interests of housing consumers and to regulate the home building industry.

KEY DELIVERABLES:


To ensure compliance with the Housing Consumers Protection Measures Act through investigation and review of matters as well as prosecution of builders as required by the Act, its Rules and Regulations.

  • Enforce the relevant provisions of the Housing Consumers Protection Measures Act, Act 95 of 1998 including the regulations and the code of conduct to ensure compliance with the law;
  • Review files for possible suspension of defaulting home builders and decide on prospects of successful prosecution;
  • Formulate and draft charges to be proffered against defaulting home builders at Disciplinary Hearings;
  • Issue summons and prepare disciplinary hearing packs;
  • Consult with witnesses to ensure successful prosecution of maters;
  • Represent the NHBRC at the disciplinary committee hearings;
  • Make recommendations on sanctions to be imposed at the DC hearings and ensure compliance of the DC rulings;
  • Advise home builders, housing consumers and other interested parties in writing of the outcome of the DC hearings;
  • Ensure that criminal actions are instituted against persons who carry on the business of a home builder without having registered with the NHBRC;
  • Monitor and supervise investigators, Legal officers and Para Legal to ensure efficient enforcement of the Act;
  • Conduct workforce planning to ensure team is suitably staffed to meet objectives, taking into account various internal and external factors;
  • Set medium to long term goals and objectives for the relevant area of control and monitor progress of the achievement of objectives;
  • Conduct training and/or awareness campaigns for both internal and external stakeholders to ensure understanding of the Act, the regulations and the Code of Conduct;
  • Provide relevant support to stakeholders to ensure team objectives are achieved;
  • Provide legal advice and support to internal and external stakeholders in relation to applicable legislative and regulatory framework;
  • Conduct legal research to remain abreast with the relevant and applicable laws;
  • Establish and maintain relations with key internal and external stakeholders to ensure support and corporation within the industry;
  • Assist the Manger in the review of enforcement policy, procedures and process maps;
  • Prepare monthly and quarterly reports on work done to the Manager;
  • Prepare ad-hoc reports for submission to the NHBRC Management Committees of Council and other stakeholders as requested by Manager;
  • Attend and present matters to Management, Executive and Council Committees and other as and when requested by the Manager;
  • Provide support and assistance to the Manager as and when requested;
  • Attend to necessary administrative functions to ensure efficiency in the enforcement/prosecution portfolio;
  • Attend and participate in committees and forums;
  • Prepare submissions as and when requested to do so by the Manager Enforcement;
  • Implement, drive and manage all people development initiatives such as performance management, succession planning, talent management, etc. to ensure team performance meet required standards;
  • Assure stable employee relations by managing conflict and creating a positive working environment;
  • Identify and recommend initiatives aimed at saving costs for the Section;

MINIMUM REQUIREMENTS

  • LLB or equivalent qualification;
  • Minimum of 5 years’ experience in Public Prosecution and/or Criminal Litigation;
  • Excellent writing and communication skills;
  • Be computer literate;
  • Must have a driver’s license and be willing to travel;
  • Exposure or experience in the built industry will serve as an advantage.

APPOINTMENT

The above-mentioned position will be offered on a permanent basis with a Total Cost to Company Package.
