POSITION: Legal and Compliance Manager

DEPARTMENT: Sasai Econet Financial Services

REPORTING TO: GM – Sasai Econet Financial Services

PURPOSE:

To develop, coordinate, prepare contracts and manage contractual commitments across the business units. Also to develop, coordinate and manage the implementation of best legal and compliance practices. To manage litigation through provision of written legal advice (opinion).

Key duties/Responsibilities

· Reviews contracts, drafts business contracts and manages contracts life circle of SEFS department;

· Researches and acquaints self with developments and trends on the global/international arena of telecommunications and mobile financial systems to ensure that the business to remain compliant and strategically competitive;

· Ensures that SEFS Contracts Management Policy is known and followed by all its Users;

· Where requested, assists the requesting department in contract discussions with the other parties and ensures that agreed terms are legally sound and reflect the business position;

· Advises business units on legal matters and necessary approaches;

· Creates a risk rated compliance universe and ensure compliance therewith;

· Reports back to business functions on current risks and compliance performance, highlighting or escalating areas of concern and contribute to robust and effective compliance controls within the organization;

· Reviews marketing materials, presentations and websites to ensure compliance with regulatory requirements;

· Collaborates with other departments to create a culture of compliance;

· Handles all compliance complaints made against SEFS;

· Reports in terms of Money Laundering Proceeds of Crime Act;

· Conducts training sessions on AML policies and procedures to SEFS employees who handle financial transactions or are involved in risk assessment activities.

Qualifications & Experience:

· LLB Degree

· PGD in Risk and Compliance Management

· 3 years’ experience in Legal and Regulatory Compliance experience

· Knowledge of related and applicable Lesotho Laws, rules and regulations

· Professional certification in regulatory compliance will be an added advantage

· Membership of a related Professional body will be an added advantage

· Experience in telecommunications

Knowledge Areas & Competencies:

· Proficiency in mobile money regulations

· Clear verbal and written communication and ability to prepare reports

· Ability to plan and organise in line with job requirements

· Ability to analyse and solve work related problems to achieve the correct outcomes

· Ability to interact, negotiate (where applicable) and achieve targets
