Position Title: Head of Legal

  1. Position Summary

The Head of Legal is responsible for overseeing all legal matters related to the company’s construction projects, ensuring compliance with relevant laws, managing contractual risks, handling disputes, and providing strategic legal advice to senior management. This role requires expertise in construction law, contract negotiation, regulatory compliance, dispute resolution, and risk management.

The ideal candidate will work closely with internal teams, external legal advisors, and government authorities to safeguard the company’s interests while ensuring smooth project execution.

2. Key Responsibilities

  • Legal Strategy & Compliance
  • Develop and implement the company’s legal framework to support construction operations.
  • Ensure compliance with construction laws, labor laws, procurement regulations, and environmental laws.
  • Monitor legislative and regulatory changes affecting the construction industry and provide legal guidance.
  • Contract Management & Negotiation
  • Draft, review, and negotiate construction contracts, subcontracts, joint venture agreements, and supplier agreements.
  • Ensure that all contracts mitigate legal risks while protecting the company’s financial and operational interests.
  • Provide legal oversight on tendering processes, procurement contracts, and service-level agreements.
  • Dispute Resolution & Litigation
  • Handle and resolve construction disputes, including contract breaches, delays, and non-performance issues.
  • Represent the company in arbitration, mediation, and litigation proceedings.
  • Engage and manage external legal counsel when necessary.
  • Conduct legal risk assessments and provide recommendations to management.
  • Develop internal policies and compliance programs to minimize exposure to legal liabilities.
  • Advise on corporate governance matters, ensuring that the company adheres to legal and ethical standards.
  • Work with government agencies to ensure permits, licenses, and regulatory approvals are obtained and maintained.
  • Represent the company in legal negotiations and stakeholder engagements.
  • Lead and manage the legal department, including legal officers and compliance professionals.
  • Provide legal training to internal teams, particularly on contract management and compliance matters.
  • Foster a culture of compliance and risk awareness within the organization.

3. Qualifications & Experience

  • Education & Certification
  • Master’s degree in Law (LLM), Business Law, Construction Law, or a related field.
  • Admission to practice law by the High Court of the Kingdom of Lesotho.
  • Minimum 5 years of legal experience, preferably in the construction industry or a corporate legal environment.
  • Strong background in contract law, construction law, dispute resolution, and regulatory compliance.
  • Experience handling high-value contracts, legal negotiations, and risk assessments.

4. Key Competencies

  • Legal Expertise: Strong understanding of construction law, contracts, and regulatory frameworks.
  • Negotiation & Dispute Resolution: Ability to handle contract negotiations, disputes, and litigation matters.
  • Risk Management: Proactively identify and mitigate legal risks affecting construction projects.
  • Leadership & Team Management: Lead and mentor legal and compliance teams.
  • Communication & Advisory Skills: Provide clear legal guidance to executives and project managers.
  • Regulatory Compliance Knowledge: Expertise in local and international construction and corporate laws.
  • Ability to travel to project sites and attend legal proceedings when required.
  • Availability to handle urgent legal matters and crisis situations.
  • Ability to work under high-pressure environments, especially in dispute resolution.
