Applications are invited From suitably qualified local candidates for the following position tenable in the Ministry of Labour and Employment:

Job Title: Director Legal Services
Grade: J
Responsible To: Principal Secretary
Job Summary
To oversee the provision of legal advice to Heads of Department, ensure that the Ministry complies with labour laws, drafts legislation, reviews policies, and ensures that the Ministry is represented in legal matters. Advises Heads of Departments on matters bearing juristic nature and requiring legal opinion.
Main Duties
1. Tenders Legal Advice to the Principal Secretary and All Ministry Departments
- Analyses legal advice requests from management and departments
- Implements management decisions as per legal advice
- Conducts research on identified legal issues
- Provides legal advice on human resource-related issues
2. Provides Legal Opinion on National and International Instruments
- Analyses national and international instruments, documents, or agreements
- Identifies legal issues in these instruments
- Provides legal advice or opinion to concerned departments
3. Drafts Labour Legislation
- Participates in drafting, reviewing, and amending legislation and internal policies to align with international standards
- Coordinates consultations with relevant ministries/departments
- Provides drafting instructions to the Law Office
- Follows up on the drafting of the Bill
- Prepares Cabinet Memoranda and accompanying documentation
4. Coordinates Drafting of Contracts and Agreements
- Participates in contract/agreement discussion forums
- Advises the Ministry on all contracts/agreements entered into
5. Coordinates Representation of the Ministry in Litigation
- Analyses the nature of cases
- Coordinates and assigns the Ministry’s legal team for litigation support
- Liaises with the Attorney General’s Office
6. Oversees Compliance with Court Judgments
- Advises management to direct relevant departments to comply
- Follows up to ensure compliance
7. Coordinates State Reporting Process
- Ensures accuracy and consistency in country reports submitted on ratified conventions
- Advises the Ministry on observations and recommendations issued by supervisory bodies
8. Establishes Feasible Options to Enhance Legal Unit Performance
- Draws annual work plans for the Legal Unit
- Conducts quarterly appraisals for Legal Unit staff
- Compiles progress reports from Legal Unit staff
- Produces quarterly reports and submits to the Principal Secretary
Job Specification
Education and Experience
- LLM plus 5 years working experience
- OR LLB with at least 10 years working experience in a managerial position
Responsibility for Work of Others
- Supervises and directs all Legal Unit staff
Responsibility for Safety
- Responsible for safekeeping of valuable assets and documents
Responsibility for Safety of Others
- Minimal in this job
Complexity
- Requires ability to read comprehensive documents addressing complex issues such as cases, international instruments, and agreements
Authority for Decision Making
- Advises Ministry management and departments on legal matters
Problem Solving
- Proactively addresses legal challenges and ensures compliance with labour laws, financial rules, Constitution of Lesotho, Procurement Act, and Public Service regulations
Dexterity
- Advises on legal matters at ministerial level; requires high mental and visual concentration

Mental Effort
- High mental effort required, especially during contract/agreement discussions; involves extensive reading
