Applications are invited from suitably qualified local candidates for the following position:


POSITION: Director Legal

Grade: I
Number of Positions: One (1)
Department: Administration
Responsible To: Principal Secretary


Main Purpose of the Job

To oversee the provision of legal advice to Heads of Departments, ensure that the Ministry complies with Information, Communications, Technology and Innovation laws, facilitate the drafting and review of legislation, review and draft agreements, and ensure that the Ministry is represented in legal matters. The incumbent also advises Heads of Departments on all matters of a juristic nature requiring legal opinion.


Main Duties

1. Tenders Legal Advice to the Principal Secretary and All Ministry Departments
1.1 Analyses legal advice requests from management and departmental units.
1.2 Implements management decisions based on legal advice.
1.3 Conducts research on identified legal issues.
1.4 Provides legal advice on all matters affecting the Ministry.

2. Provides Legal Opinion on National and International Instruments
2.1 Analyses national and international documents or agreements.
2.2 Identifies legal issues in international instruments and agreements.
2.3 Provides legal advice or opinion to the concerned departments.

3. Drafts Legislation
3.1 Participates in the drafting, review, and amendment of legislation and internal policies administered by the Ministry to align them with international standards.
3.2 Coordinates consultations with all relevant ministries and departments.
3.3 Provides drafting instructions to the Law Office.
3.4 Follows up on the drafting of Bills.
3.5 Facilitates concurrence from relevant ministries.
3.6 Drafts and reviews Cabinet Memoranda.

4. Coordinates Drafting of Contracts and Agreements Between the Ministry and Other Parties
4.1 Participates in contract and agreement discussion forums.
4.2 Drafts and reviews contracts and agreements.
4.3 Checks and approves contract or agreement drafts.
4.4 Adds comments and recommendations to contracts and agreements.

5. Coordinates Representation of the Ministry in Litigation
5.1 Analyses the nature of cases affecting the Ministry.
5.2 Recommends officers to represent the Ministry.
5.3 Liaises with the Office of the Attorney General.

6. Oversees Compliance with Court Judgments
6.1 Advises management to ensure compliance by relevant departments.
6.2 Makes follow-ups to confirm that compliance has been achieved.

7. Coordinates Country Reporting Process
7.1 Ensures accuracy and consistency in country reports submitted on ratified conventions.
7.2 Advises the Ministry on observations and recommendations issued by supervisory bodies.
7.3 Ensures compliance with international Information, Communications, Science, and Technology standards.

8. Establishes Feasible Options to Enhance Performance of the Legal Unit
8.1 Develops annual work plans for the Legal Unit.
8.2 Conducts quarterly appraisals for Legal Unit staff.
8.3 Compiles progress reports from Legal Unit staff.
8.4 Produces quarterly reports and submits them to the Principal Secretary.


Job Specification

Education and Experience

  • Master of Laws (LLM) plus at least five (5) years working experience;
    OR
  • Bachelor of Laws (LLB) with at least ten (10) years working experience in a managerial position.

Responsibilities

For the Work of Others
The incumbent is responsible for supervising and directing all Legal Unit staff.

For Safety
Responsible for the safekeeping of valuable assets and documents within his/her custody.

For Safety of Others
This factor is considered minimal for this position.


Complexity

The position demands the ability to read and interpret comprehensive documents addressing complex issues such as legal cases, international instruments, and agreements.


Authority for Decision Making

The incumbent advises the Ministry’s management and departments on all legal matters and provides informed recommendations on decisions with legal implications.


Problem Solving

Responsible for proactively addressing legal challenges within the Ministry and ensuring compliance with the Constitution of Lesotho, ICT and Innovation Laws, Labour Laws, Public Financial Laws, and other relevant national laws.


Dexterity

The position requires mental and visual concentration, analytical thinking, and a high level of legal drafting and interpretation skills.


Contacts

The incumbent will regularly engage with the Principal Secretary, departmental heads, social partners, and the private sector.


Mental Effort

The role demands high mental effort, particularly during discussions of contracts and agreements, and involves extensive reading and analysis.
