BACKGROUND AND CONTEXT

The Parliament is established by the Constitution of Lesotho under Section 54. It is composed of two houses, the Senate as upper House and the National Assembly as lower House. The National Assembly consists of a total number of 120 Members and the Senate consists of a total of 33 Senators. 22 Principal Chiefs and 11 members who are nominated by the King.

The mandate of Parliament is to 1) represent and advocate for a better life for all Basotho; 2) to make and amend laws; 3) to exercise oversight over the Executive by holding the government accountable for its acts of commission and omission, as well as 4) to appropriate funds.

The enactment of the Tenth Amendment to the Constitution of Lesotho in August 2025 has made significant changes in the structural and operational mandate of the Parliament. It introduces transformative changes across the governance architecture, including strengthening Parliament, changing reporting mechanisms to Parliament, establishing independent Commissions (Human Rights, Anti-Corruption, Media), and enhancing fiscal accountability.

Parliament needs to align with this change, its policies and the 2024–2028 strategic plans accordingly. This is largely to enable Parliament transition to full autonomy and to ensure the legislature operates efficiently and independently in the public interest and enforcing accountability of the Government, while fully aligning with the Tenth Amendment to the Constitution of Lesotho Act 2025.

It is against this backdrop that the Parliament of Lesotho wishes to engage a consultant to assist in the development of an action plan towards bringing into effect the provisions of the 10th Amendment to the Constitution.

MAIN OBJECTIVE OF THE CONSULTANCY

The objective of the consultancy is to guide the Parliament’s transition in alignment with the Tenth Amendment to the Constitution, Parliament Policy, Strategic Plans and international best practices. This requires the consultant to develop a comprehensive roadmap with a costed implementation plan for the Parliament’s transition towards full autonomy.

SPECIFIC OBJECTIVES

  • Thoroughly study the provisions of the 1993 Constitution (as amended) relating to Parliament and compare them with the provisions of the Tenth Amendment to identify key areas of reform.
  • Assess the institution’s current capacity and readiness for transition through a thorough needs assessment and gap analysis.
  • Identify potential risks, challenges, mitigation strategies and opportunities associated with the transition.
  • Make recommendations of transitional mechanisms and processes.
  • Design a roadmap with a costed implementation plan that outlines critical steps, timelines and responsibilities for all the stakeholders involved.

The assignment is expected to be completed within ninety (90) days with possibility of extension from the date of commencement.

CONSULTANCY ARRANGEMENTS

Consultants may form Joint Venture with other firms to enhance their qualification but should submit their legal JV agreement or a firm intent to form one. All partners in JVs shall be jointly and severally liable for the entire contract if selected.

The Consultant will be selected in accordance with the Quality and Cost Based Selection (QCBS) method.
