Consultancy – Assessment of Migration Policy and Institutional Framework in Botswana, Comoros, Eswatini, Madagascar, Seychelles, Namibia, South Africa, Zambia and Zimbabwe

Background: Overall context:

The Southern Africa Migration Management (SAMM) project is a model of a ONE-UN approach collaborative effort between 4 UN development and humanitarian agencies: the ILO, IOM, UNODC and UNHCR. The (SAMM) project forms part of the European Union Regional Indicative Programme (11th EDF RIP) for Eastern Africa, Southern Africa and the Indian Ocean (2014–2020) which includes among its objectives the facilitation of safe, orderly and regular migration and the prevention of irregular migration. It focuses on South-South migration flows, identifying positive spill-over effects of international migration on regional integration and regional economic development. Its overall objective is to improve migration management in the Southern Africa and Indian Ocean region guided by, and contributing to, the realization of the 2030 Development Agenda (goals 8 and 10).

It is comprised of two main project components: 1. Labour Migration and 2. Mixed Migration. The first component supports the implementation of the UN Global Compact on Safe, Orderly and Regular Migration (GCM) and the second one the application of the UN Global Compact on Refugees (GCR), as well as of the GCM.

The project focuses on the Southern African Region, and targets the following 16 SADC countries: Angola, Botswana, Comoros, Democratic Republic of the Congo (DRC), Eswatini, Lesotho, Madagascar, Malawi, Mauritius, Mozambique, Namibia, Seychelles, South Africa, Tanzania, Zambia and Zimbabwe.

Regional Migration Context

Migration dynamics and patterns in Southern Africa are complex and have evolved over the years. Due to the ever changing economic and political climate in Southern Africa, many countries have become countries of origin, transit, and destination for irregular migrants, asylum seekers, undocumented labour migrants, unaccompanied migrant children (UMC), and victims of trafficking, who move within mixed migration flows. The International Organization for Migration therefore aims to contribute towards improved migration management within the SADC region through the production and the availability of reliable and timely data on migration for policy making and development planning. Through the Strengthening IOM ‘s capacity to support policies towards facilitating orderly, safe and regular migration in Southern Africa project, and the EU-funded project on improving the management of migration in the region, the International Organization for Migration (IOM) aims to strengthen its capacity to support policies towards facilitating orderly, safe, and regular migration at the national and regional levels in Southern Africa**.** IOM therefore aims to conduct a Migration Policy Research Assessment in Botswana, Comoros, Eswatini, Madagascar, Seychelles, Namibia, South Africa, Zambia and Zimbabwe whose findings and recommendations will contribute towards improved governance and management of migration within the SADC region.**

Purpose of the Migration Policy Research Assessment in the nine countries:

The purpose of this Migration Policy Research Assessment is to assess, and document achievements, challenges and lessons learnt in the development and implementation of the migration policy and institutional framework in the nine targeted countries (NTC).

Specific Objectives:

· Assess the migration policy, institutional and legal framework in the nine SADC countries.

· Assess IOM’s contribution to the Migration Policy Development and Migration governance in in the nine SADC countries.

· Assess the achievements to date in the development of a migration policy, institutional and institutional framework for improved migration governance in the nine SADC countries.

· Assess challenges in the nine target countries’ migration policy development, legal and institutional frameworks, and limitations to full policy implementation.

· Assess and document lessons learnt in NTC’s migration policy development, legal and institutional framework and migration governance.

· Proffer recommendations for improved development and implementation of migration policy and migration governance in NTC.

· Proffer recommendations to strengthen IOM’s technical support to the Government of NTC on migration governance.

· Develop capacity building feedback session to address identified lagging behind areas.

Work under this consultancy is linked to SAMM’s Workplan as follows:

Output 3.4.3. Assist RECs and the Member States in the formulation of a Regional Migration Policy Framework, organize regional consultations for formulation and adoption of the Framework and an Action Plan, particularly:

· Activity 3.4.3.1. Assist RECs and MSs in the formulation of policy frameworks

Scope of Research Assessment:

This Research assessment is to be conducted in NTC over a period of 90 calendar days.

Research Assessment methodology

The assessment will be undertaken through a triangulation exercise of all available data to draw conclusions and findings. The research methodology includes, but is not limited to, the following:

I. Desk review of documents, reports and other relevant materials.

II. Key informant interviews with relevant Government of NTC officials, Private sector, beneficiaries, IOM staff and UN and Civil Society partners.

As part of the desk review, which will lead to an inception report, the assessors will use the project documents and reports. The consultant elaborates on the assessment methodology in an inception report, determining thereby the exact focus and approach for the exercise, including developing tailor-made questions that target different stakeholders (based on a stakeholder assessment), developing the sampling strategy and identifying the sources and methods for data collection including the data analysis and presentation. The assessment must follow the IOM Data Protection Principles, UNEG norms and standards for assessment, and relevant ethical guidelines.

The consultant is required to submit a separate final list of those interviewed in the Annex of the assessment report. The assessor will ensure a wide representation of stakeholders, bearing in mind the need to address relevant cross-cutting themes of rights-based approach to programming, gender mainstreaming, environmental sensitivity and sustainability, and sustainability of results.

Description of Duties

The consultant will work under the overall supervision of the Regional Policy Liaison Officer in coordination with the Chief of Mission/Head of Offices in the NTC countries and the SAMM Project Coordinator. In case of difficulties, uncertainties, or concern in the conduct of the assessment, the consultant needs to coordinate with the assessment coordinator to seek guidance or clarification. The consultant shall act independently, should observe the UNEG guidelines, standards, and norms for evaluations in the UN system, as well as IOM Guidelines for Evaluation, in the conduct of this assignment. The consultant will submit nine copies of edited final report to IOM.

The country offices will support the consultant, by providing desk review documents, contact details of project stakeholders as well as any additional documents. . The country office project team will review and provide comments on the inception, draft and final reports with a view on quality assurance and factual accuracies. The country offices will assist in reviewing the capacity building module to be used for supporting the government.

Assessment work plan and Deliverables:

Payment Schedule

The Total fee, inclusive of related costs, not subject to any deductions, will be paid to the consultant as follows.

  • 20 % upon the satisfactory completion of the deliverable 1 and 2
  • 40 % upon the satisfactory completion of the deliverable 3, 4, 5, 6 and 7
  • 40 % upon the satisfactory completion of the deliverable 8 and 9.

Profile of the assessment team

Consultant with experience in conducting the research assessment. The assessment team is expected to follow the OECD-DAC standard evaluation criteria as adopted by the EU and to adhere to the IOM assessment Guidelines and UNEG norms, standards and ethical guidelines.

Desirable Qualifications:

Desirable qualifications and educational background for the consultancy are as follows.

· Advanced University degree in Political, Social Science or Public Administration, International Relations, Law or an equivalent combination of relevant training and experience in policy development

· Minimum of 10 years of relevant professional experience in migration related fields and policy formulation and reviews, research including working with governmental, inter-governmental, or non-governmental organizations.

· Knowledge of migration issues in the region

· Excellent operational, organizational and communication skills and the ability to work harmoniously with other colleagues from diverse backgrounds.

· Demonstrated ability to work in a multicultural environment and establish harmonious and effective relationships.

· Proven capacity to coordinate all administrative and technical aspects of the consultancy
