Applications are invited from suitably qualified local candidates for the following vacant positions tenable at the Judiciary:
DEPARTMENT: Judicial Commissioner’s Court
JOB TITLE: Clerk of Court
GRADE: C
RESPONSIBLE TO: Senior Clerk of Court
JOB SUMMARY
Under close supervision of the Senior Clerk of Court, the incumbent is responsible for case registration, issuance of court process, custody of court records, and prosecution of cases.
MAIN DUTIES
1. Case Registration and Allocation
1.1 Receives case record from the Central and Local Court
1.2 Peruses the file to ensure that file index and proceedings correspond
1.3 Registers the case
1.4 Receives application for certificate from the litigant lodging an appeal
1.5 Submits the application to the Judicial Commissioner to grant or reject the application for certificate
1.6 Issues a certificate for appeal if granted by the Judicial Commissioner
1.7 Determines and notifies the litigant of the appeal fee and security costs
1.8 Allocates the case to the judicial officer for adjudication
1.9 Checks the judicial officer’s diary and gives hearing dates
2. Issuance of Court Processes and Prosecution of Criminal Cases
2.1 Issues subpoenas for witnesses called to notify them of the nature of litigation and date of hearing
2.2 Issues summons for accused persons in criminal cases to inform them of the nature of the alleged crime and the date of hearing
2.3 Checks returns submitted by the court messenger to prove service of the court processes
2.4 Files the return in the case file
2.5 Prosecutes criminal cases
2.6 Issues the bill of costs
3. Custodian of Records
3.1 Allocates numbers to each file to give it a distinct identity
3.2 Maintains the security of the records
3.3 Fills the movement card on release of a file from position
3.4 Maintains the filing index
3.5 Issues return to Central and Local Courts upon completion of a case
EDUCATION AND SKILLS
COSC or LGCSE with passes in English and Sesotho Languages
OTHER RELEVANT KNOWLEDGE
Knowledge of court rules and procedure.
RESPONSIBILITIES
a) For work of others:
The incumbent is responsible for supervision of the work of the court messengers.
b) For property (equipment, material and court fees):
The incumbent is responsible for keeping safe the material, equipment allocated to them, and funds collected.
